Now that CNET and Zdnet are one and the same, I guess they repost each
toheres stuff.  This is the same with a different title ;)

We're not expecting litigation.  We believe we are patent free, and have
done the necessary research to substantiate this claim. And we keep an
eye out.

But the legal system works against us in some ways.  At *any* moment,
pretty much any company could file suit with us.  And if it weren't for
an overarching organization (which in some ways there always has been),
who would they sue?  Probably Monty and I, but there is a possibility
they would go after other copyright holders.  In any case, this gives
everyone a legal shield, so at least the worst that can happen is the
Foundation goes down in flames.

We might not lose a suit, but we can definately get sued. :)

I hope this clears up that somewhat.
