It's not. For that matter there's nothing in the ogg spec that says it 
has to be byte aligned.

Also note that in vorbis, the 'vorbis' magic actually comes after a 
packet type marker, '0x01'. Since it's always the same, magic detection 
still works. Theora is the same, with a different header value.
