Because to broadcast at all you had to agree to it.  The DMCA set this
up in 1998.  If you were broadcasting under teh compulsory license, then
you agreed to pay whatever was decided retroactively.

If you didn't broadcast under the compulsory license, and had not
negotiated with every copyright holder, then you were probably doing so
illegally.

Certainly all of the commercial companies doing broadcasting had
compulsory licenses that I know of.
