This is the case.  But does not apply here.

The codec is LGPL to be commercial app friendly.  They are free to use
it.  There is also no one stopping anyone from reimplemnting the spec,
just as the Jorbis folks have already done.

We don't make vorbis ubiquitous by alienating commercial software. :)

The game companies are interested in vorbis, and this is a good thing :)
