Maik was I think confused when he agreed that theora infringed. Perhaps 
he can clarify?

That would improve the level of the discussion, certainly.

It's an argument that the risk is low, yes, and it's something you can 
use to gauge the balance of power without paying for your own patent 
search. Just like the fact that Thompson never sued anyone over Vorbis 
argues well that they felt they had no case despite certain public 
statements to the contrary.[*]
